Terms of Service

1. Agreement

These Terms of Service govern your purchase and use of TalkingKey (the "Software"), a macOS application provided by PT ITropical Live Solutions ("we", "us"). By purchasing, downloading, or using the Software you agree to these terms. If you do not agree, do not use the Software.

2. Licence

On purchase you receive a personal, non-exclusive, non-transferable licence to install and use one copy of the Software for your own use. Each purchase includes a licence key with a set activation limit shown at checkout. You may not resell, redistribute, sublicense, rent, or reverse-engineer the Software except where such restriction is prohibited by law.

3. Trial and updates

TalkingKey includes a time-limited free trial so you can evaluate it before buying. A one-time purchase includes updates within the same major version. We may offer paid upgrades for future major versions.

4. Payments

Payments are processed by our payment provider, who acts as the Merchant of Record and reseller of this product. Your payment contract is with them, and they collect and remit any applicable sales tax and VAT. The provider is named in our Legal Notice.

5. Refunds

Refunds are handled as described in our Refund Policy.

6. Intellectual property

The Software, its branding, and all related materials remain our property or that of our licensors. This licence grants you no ownership of the Software itself. Speech recognition runs on an open-source model downloaded to your Mac on first run; that model is subject to its own licence.

7. Warranty disclaimer

The Software is provided "as is" and "as available", without warranty of any kind, express or implied, including fitness for a particular purpose. Speech transcription is inherently imperfect and results may vary. You are responsible for reviewing transcribed text before relying on it.

8. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages, or for loss of data or profit, arising from your use of or inability to use the Software. Our total liability shall not exceed the amount you paid for the Software.

9. Termination

This licence ends automatically if you breach these terms. On termination you must stop using and delete the Software.

10. Governing law

These terms are governed by the laws of the Republic of Indonesia, without regard to conflict-of-law rules. Mandatory consumer-protection rights in your country of residence remain unaffected.

11. Changes

We may update these terms; the version in force at the time of your purchase applies to that purchase. Material changes will be reflected by the "Last updated" date above.
